This website is operated under the Ameliarush trading name by Textiel Expert, a Dutch general partnership (Vennootschap Onder Firma). Throughout the website, the terms "we", "us" and "our" refer to Ameliarush and Textiel Expert.
Ameliarush offers this website, including the information, products, features and services made available through it, subject to your acceptance of these Terms of Service.
By visiting our website and/or purchasing from us, you agree to be bound by these Terms of Service, together with any additional policies referred to on the website, including our Privacy Policy, Shipping Policy and Return Policy.
Please read these Terms carefully before using our website or placing an order. If you do not agree with these Terms, you should not use the website or purchase products through it.
We may update these Terms from time to time. The version published on the website at the time of your purchase will apply to that order, except where a change is required by applicable law.

Ameliarush sells home textile products online, with a focus on premium curtains designed to bring comfort, privacy and style to interior spaces.
SECTION 2 - ELIGIBILITY AND ACCEPTABLE USE
By using this website, you confirm that you are legally capable of entering into a binding agreement under the laws applicable to you.
You may not use our website, products or services for any unlawful, fraudulent or unauthorized purpose. You must not introduce viruses, malicious code, automated scraping systems or other technologies that could harm, overload, interfere with or compromise the operation or security of the website.
We may restrict or terminate access to the website where we reasonably believe these Terms or applicable law have been violated.
SECTION 3 - PRODUCTS AND PRODUCT INFORMATION
We make reasonable efforts to ensure that product descriptions, photographs, measurements, materials, prices and other information displayed on our website are accurate and up to date.
Because curtains and other textile products may appear differently depending on lighting, screen settings, photography and the natural characteristics of fabrics, slight differences in colour, texture or appearance may occur. These differences do not affect your statutory rights where a product is faulty, damaged or not as described.
Customers are responsible for checking product information and measurements carefully before placing an order.
Product availability may change without notice. We reserve the right to discontinue a product or limit available quantities.
SECTION 4 - PRICES
All prices are displayed in euros unless stated otherwise.
The price shown at checkout, together with any applicable shipping charge, is the total amount payable for the order unless a correction is required because of an obvious pricing or technical error.
We may change product prices at any time. A price change will not affect an order that has already been accepted by us.
SECTION 5 - ORDERS AND CONTRACT FORMATION
Submitting an order through our website constitutes an offer to purchase the selected products.
After an order is placed, you will normally receive an electronic order confirmation. This confirms that we have received your order but does not prevent us from cancelling or correcting an order where there is a legitimate reason to do so, including product unavailability, suspected fraud, an obvious pricing error, incorrect payment information or an inability to deliver to the address provided.
If we cancel an order after payment has been received, the relevant amount will be refunded using the original payment method.
We reserve the right to limit or refuse orders that reasonably appear to be placed for unauthorized resale, fraud or other improper commercial purposes.
SECTION 6 - CUSTOMER INFORMATION
You agree to provide complete, current and accurate information when placing an order, including your name, email address, billing details and delivery address.
You are responsible for checking the information entered before completing your purchase. If you discover an error after ordering, contact us as soon as possible. We cannot guarantee that an address or order can be changed after fulfilment has started.
SECTION 7 - SHIPPING AREA
Ameliarush currently ships orders only to addresses in the Netherlands.
Orders are dispatched from fulfilment locations in Germany or France.
We do not currently offer delivery to addresses outside the Netherlands through the Ameliarush webshop.
SECTION 8 - SHIPPING OPTIONS AND DELIVERY ESTIMATES
Customers can choose between the following shipping options at checkout:

Estimated delivery time: 4-5 business days
2. Insured Express Shipping
Cost: EUR 4.95
Estimated delivery time: 2-3 business days
Delivery estimates are stated in business days and are estimates rather than guaranteed delivery dates unless we expressly agree otherwise.
Delivery times may be affected by carrier delays, public holidays, peak shopping periods, incorrect delivery information, severe weather or other circumstances outside our reasonable control.
Where a delivery is delayed, your statutory rights under Dutch consumer law remain unaffected.
SECTION 9 - DELIVERY AND RISK
We are responsible for the order until it has been delivered to you or to a person designated by you, subject to applicable law.
Please inspect your order after delivery. If a parcel arrives damaged, incomplete or contains an incorrect item, contact us as soon as reasonably possible so that we can investigate and provide an appropriate solution.
If a parcel cannot be delivered because the delivery address supplied by the customer was incorrect or incomplete, additional delivery costs may apply where legally permitted.
SECTION 10 - RIGHT OF WITHDRAWAL
If you are purchasing as a consumer, you generally have a statutory right to withdraw from an online purchase within 14 days without giving a reason.
For goods, the withdrawal period generally begins on the day after you, or a third party designated by you other than the carrier, receives the goods.
To exercise your right of withdrawal, you must clearly inform us of your decision within the applicable withdrawal period. You may use the withdrawal method, cancellation button or model withdrawal form made available through our website.
After notifying us of your withdrawal, you must return the goods within the period required by applicable law.
The statutory right of withdrawal may not apply to certain products where an exception is permitted by law, including goods made to a consumer's specifications or clearly personalized. Where an exception applies to a particular product, this will be communicated before purchase.
Nothing in this section limits any rights you have in relation to faulty, damaged or incorrectly supplied products.
SECTION 11 - RETURNS AND REFUNDS
Returns are handled in accordance with our Return Policy and applicable Dutch consumer law.
When a valid statutory withdrawal is exercised, we will refund the amounts we are legally required to refund within the period prescribed by law. We may withhold reimbursement until we have received the returned goods or until you provide evidence that the goods have been sent back, where permitted by law.
Unless otherwise required by law or stated in our Return Policy, the customer is responsible for the direct cost of returning a product after exercising the right of withdrawal.
If a product is defective, damaged on arrival or incorrectly supplied, please contact us so that we can arrange an appropriate remedy in accordance with your statutory rights.
Products should be handled only to the extent reasonably necessary to establish their nature,
characteristics and functioning. A reduction in value caused by handling beyond that may be deducted from the refund where permitted by law.
SECTION 12 - STATUTORY GUARANTEE AND CONFORMITY
Products purchased from Ameliarush must conform to the sales agreement and meet the reasonable expectations a consumer may have based on the product description, price, intended use and other relevant circumstances.
If a product is defective or does not conform to the agreement, you may have rights to repair, replacement, price reduction or termination of the purchase, depending on the circumstances and applicable law.
These statutory rights are not limited by any commercial guarantee that may separately be offered.
SECTION 13 - ACCURACY OF WEBSITE INFORMATION
We aim to keep information on our website accurate, complete and current. However, typographical errors, technical issues, outdated information or other inaccuracies may occasionally occur.
We reserve the right to correct errors, update information or cancel an affected order where legally permitted. If an error materially affects an order you have already placed, we will contact you where appropriate.
SECTION 14 - CHANGES TO PRODUCTS, PRICES AND SERVICES
We may modify, suspend or discontinue products, website features or services from time to time.
We may also change prices, product descriptions or availability. These changes will not affect rights that have already arisen under an accepted order.

Our website may contain links to, integrations with or services provided by third parties, including payment providers, shipping carriers and technology providers.
Third-party websites and services are governed by their own terms and privacy policies. We are not responsible for third-party content or services except to the extent that applicable law makes us responsible.

SECTION 17 - USER CONTENT AND FEEDBACK
If you voluntarily submit a review, photograph, comment, suggestion or other content to us, you confirm that you have the right to provide it and that it does not violate the rights of another person or applicable law.
Where you submit content for publication, you grant us a non-exclusive right to use, reproduce and display that content for the purposes for which it was submitted, subject to applicable privacy and intellectual property laws.

Nothing in these Terms limits rights granted to consumers by mandatory applicable law.

These Terms and any agreement arising from a purchase through Ameliarush are governed by Dutch law.
If you are a consumer, you also retain any mandatory rights and protections available to you under applicable consumer law.
Disputes will be submitted to the competent courts in the Netherlands unless mandatory law provides otherwise.
SECTION 25 - CHANGES TO THESE TERMS
We may revise these Terms from time to time to reflect changes to our website, business practices or legal requirements.
The latest version will be published on the website. Changes will apply from the date they are published unless stated otherwise and will not improperly remove rights that have already arisen under an existing purchase.
